James Potts, Legal Services Director at Peninsula UK, outlines the tribunal decision in the Ms C Allette v Scarsdale Grange Nursing Home Ltd case. which found that the refusal by an employee to be vaccinated constituted a failure to comply with a reasonable management instruction, justifying a dismissal on the grounds of conduct.
